Brief Summary of Job Duties

Using independent judgment and maintaining an experienced level of professionalism knowledge and confidentiality, the Case Resolution Officer implements and maintains the University's policies and procedures that pertain to the Title IX office by independently evaluating and simultaneously responding appropriately to multifaceted claims, which entail considerable risk in the event of audit and/or litigation, and the immediate needs of complainant(s), witness(es), reporting party or parties and respondent(s) for supplemental assistance with regard to interim protections and accommodations, if appropriate, and personal and/or emotional support resources.

Required Qualifications

  • Bachelor's degree in a related field or equivalent experience and/or training.
  • Experience interacting with constituents that are diverse in characteristics such as age, education level, race, gender identity & expression, ability, & socioeconomic backgrounds, in a culturally-competent manner.
  • Two years of related experience, or equivalent experience and training.
  • Advanced knowledge of professional compliance and investigation standards.
  • Demonstrated experience conducting investigations within complex organizations,
  • including the ability to demonstrate political astuteness while conducting investigations.
  • Demonstrated knowledge and ability to interpret federal and state equal opportunity and non-discrimination laws, regulations and policies.
  • Ability to extract, verify, compile and develop recommendations related to ethics and compliance programs, issues, policies and procedures.
  • In-depth abilities in collaboration, facilitation, mentorship, and strategic and creative thinking.
  • Excellent interpersonal and problem-solving skills to work independently with all levels of University personnel, including management and faculty.
  • Ability to present complex issues in a clear and concise manner, both in writing and verbally for presentation or review by management.

Preferred Qualifications

  • Title IX investigation certification.
  • Training in trauma-focused approach to investigations.
  • Knowledge of higher education processes, protocols and procedures or experience with a similarly complex organization.

Job Functions/Percentage of Time/Duties

Complaint Resolution Process 90%

Implements and maintains the University's response policies and procedures by independently evaluating and simultaneously responding appropriately to multifaceted claims under the Sexual Violence and Sexual Harassment Policy and the nondiscrimination policies; all of which entail considerable risk in the event of audit and/or litigation, as well as to the immediate safety and well-being of complainant(s), witness(es), reporting party or parties and respondent(s) by helping to procure supplemental assistance with regard to interim protections and accommodations, if appropriate, and personal and/or emotional support resources.
Promptly assesses new complaints for potential policy violation(s) and formulates response(s) based on intake results, procured documentation and similar, historical patterns within the associated department.

Independently performs investigations in complex and/or high-profile complaints. Conducts interviews with complainant(s), respondent(s), reporting parties, and witnesses. Reviews and interprets relevant data and documentation as they pertain to the alleged claims. Ensures appropriate interaction with and notification of all relevant internal parties at UCSB and/or external representatives in relation to filed complaints and investigations.

Makes probable cause determinations, prepares written factual findings and determines resolution recommendations, assesses potential liability and campus impact. Produces resultant documentation with a view to its potential discoverability in legal and quasi-legal proceedings. When making referral to campus and/or external resources, directly interacts with noted resources to ensure continuity of service and/or support.

Acts as primary liaison in joint investigations with other campus resources.

Oversees the administrative management of complaint records and regularly updates the complaint database.

Policy Advisement for Campus 5%

Maintains experienced knowledge of relevant federal and state laws, university policies, local campus procedures, department case history and political environments relevant to Title IX.

Reviews campus discrimination, sexual harassment, and sexual violence complaint processes and suggests updates to campus stakeholders in an effort to comply with updated policies and definitions of discrimination, sexual harassment, and sexual violence.

Advises campus departments and individuals on complaint and investigation policies, procedures and best practices.

Assists Director and other Title IX staff in advising campus leadership on the following policies:

  • UC Policy on Sexual Violence and Sexual Harassment
  • UC Anti-Discrimination Policy
  • UC Staff Personnel Policy 12 Non-Discrimination in Employment
  • UC Staff Personnel Policy 70
  • APM 015 Faculty Code of Conduct
  • UC Non-Discrimination Policy Statement for UC Publications Regarding Student-Related Matters
  • UCSB's Athletics Department Gender Equity Policy

Legal Research & Analysis 5%

Conducts extensive research on state and federal laws regarding discrimination, sexual violence, and sexual harassment laws and regulations. Keeps abreast of relevant new legislation and legal practices. Reviews both campus and UC policies and recommends appropriate updates and revisions.
